What is a Negligence Action?

Briefly, the plaintiff must prove four factors:

  1. The defendant owed a duty to the plaintiff
  2. The defendant violated or failed to fulfill that duty
  3. Because of the defendant’s violation of that duty, the plaintiff was injured
  4. The injury was indeed a reasonably foreseeable consequence of the actions or inactions of the defendant

Making Sense of This – a Simple Example:

All drivers have a duty to pay attention to the road, to operate their vehicle safely, to abide by the posted speed limits and to not drive recklessly, drunk or in a dangerous manner. If driver “A” violates one of these conditions, and injures another driver, they may be found guilty of a personal injury action. The injured party may seek compensatory damages, including the following (these are examples – speak with your attorney for specifics):

  • Compensation for all hospital and medical bills and resulting medical treatments until the injured victim is healed
  • Compensation for lost income and projected lost earnings starting from the time of the accident
  • Compensation for physical and emotional pain and suffering
  • Property damage for vehicle replacement or repair
  • If the accident-causing driver behaved in an especially egregious manner – for example, driving under the influence of drugs and/or alcohol – punitive damages may be sought
  • Compensation may be sought for loss of companionship and loss of ability to enjoy life
  • Other
